green card lottery winner?

a friend of mine came to the us on Visitors visa but he have overstayed it and it has expires.fortunately he entered the green card lottery for 08-09 and he was notice he have won.Now the questions is can he applied for ajustment of status in that category?

Actually the Green Card Lottery is NOT a BS. I thought so too, until I met someone who is legally here on a Green Card Lottery, later he brought his wife too. He now works for the Army Reserves and is living a good life.

As for your question, I think you MUST talk to an Immigration Lawyer, someone who wont suck the blood out of you, but a decent compassionate kind and merciful one. Things have changed on immigration policies since 2001 and matters such as over staying and staying illegal has become serious offense in their eyes. Things are lot black and white these days. Take your immigration lawyers advise. (You may perhaps have to leave the country until he works out things and make your papers official status.)
